Speech Judge Robert Spano: Don‘t Kill the Messenger – Delfi and Its Progeny in the Case-Law of the European Court of Human Rights

Judge Robert Spano of the European Court of Human Rights presented an extensive comment on the famous Delfi case and related internet-issues during a speech he delivered on the 8th of September 2017 at a conference in Tallinn. On 28 October 2016 he visited the Institute for Information Law and discussed the case at an IViR round table meeting. In his speech, Judge Spano takes the position that intermediary liability must be examined within a holistic analytical framework of Internet Governance, followed by an in-depth analysis of the jurisprudence and inspiring observations on the notice-and-take-down system and the current framework of self-regulation and resolution of such requests.
