Finally, based on this analysis, it identifies the normative gaps that should be addressed in order to properly respond to the most pressing challenges to the safety of journalists in the years to come.

Verder blijkt het toezicht op dit wettelijk kader vrij gefragmenteerd te zijn. Op basis van deze analyse komt het rapport tot aan aantal aanbevelingen. De aanbevelingen hebben onder andere betrekking op het gebruik van de term desinformatie als beleidsterm, het omgaan met de spanningen op de verschillende beleidsniveaus, de regulering van internettussenpersonen door middel van transparantie verplichtingen en de samenwerking tussen de verschillende toezichthouders.
Voorafgaand aan deze eindrapportage is in eind 2019 het interim-rapport gepubliceerd. Dit rapport focuste op de relatie tussen desinformatie en online politieke advertenties. Verder blijkt het toezicht op dit wettelijk kader vrij gefragmenteerd te zijn. Op basis van deze analyse komt het rapport tot aan aantal aanbevelingen. De aanbevelingen hebben onder andere betrekking op het gebruik van de term desinformatie als beleidsterm, het omgaan met de spanningen op de verschillende beleidsniveaus, de regulering van internettussenpersonen door middel van transparantie verplichtingen en de samenwerking tussen de verschillende toezichthouders.
Voorafgaand aan deze eindrapportage is in eind 2019 het interim-rapport gepubliceerd. Dit rapport focuste op de relatie tussen desinformatie en online politieke advertenties. Dit artikel staat stil bij deze terminologische verschuiving en legt uit waarom het van belang is afstand te nemen van de term ‘fake news’. Vervolgens wordt de angst voor schadelijke gevolgen van ‘fake news’ of desinformatie met de nodige
nuchterheid geanalyseerd. Is er reden voor zorg en zo ja, welke juridische, politieke en praktische maatregelen heeft de Raad van Europa tot haar beschikking om (online) desinformatie tegen te gaan? Verder wordt ook onderzocht of, en in hoeverre, deze maatregelen hun grondslag vinden in de (negatieve en) positieve verplichtingen van Verdragspartijen bij het EVRM. Het artikel sluit af met een conclusie en enkele aanbevelingen voor het ontmantelen en het terugdringen van online desinformatie. },

This study will first briefly give a theoretical framework for the relationship between regional media and participation in democratic society. It will then provide a comprehensive overview and analysis of Council of Europe standards that are of relevance to the regional media and therefore shape the environment in which they operate. Against that backdrop it will select and comment on different (national) regulatory, policy approaches to regional media and best or interesting practices. The study will identify and examine a range of challenges facing regional media – legal, political, cultural, linguistic and economic. The existing European regulatory framework for public service broadcasting/media is extensive and spans legal and policy instruments emanating primarily from the European Union and the Council of Europe, but also including standard-setting measures from other intergovernmental organizations (IGOs) such as UNESCO (United Nations Educational, Scientific and Cultural Organization) and, to a lesser extent, the Organization for Security and Co-operation in Europe (OSCE). Even within the European Union and the Council of Europe, differences of focus and emphasis may readily be detected across the most salient instruments. They engage with the issues highlighted in the preceding paragraphs to varying extents.
The principal aim of this chapter is to present a panorama of regulatory instruments applicable at the European level and to assess their overall coherence. The significance of selected examples of divergence in the broader regulatory approach will be explained and evaluated accordingly.

This book offers a rigorous, theory-based, and uniquely comprehensive, analysis of European and international legal standards shaping minorities’ right to freedom of expression. The analysis pays particular attention to the instrumental role played by traditional and new forms of media in ensuring that the right to freedom of expression of persons belonging to minorities is effective in practice. The relevant international legal framework is set out in detail, including a careful examination of the relationship between generalist and minority-specific international human rights instruments. Due attention is paid to the historical circumstances in which key instruments were developed and the contemporary context in which they are now being interpreted. The analysis is also informed by an awareness of institutional and political dynamics. All of this forms the basis for the book’s central objective: to mount a critical evaluation of the existing international legal framework governing freedom of expression for minorities, while drawing on theoretical insights gained from human rights scholarship and communications science. Dr. Tarlach McGonagle is Programme Director of the master Information Law and associate professor at IViR. He is also Professor of Media Law & Information Society at Leiden Law School (a part-time chair financed by the Leiden University Fund). McGonagle specialises in a broad range of topics relating to international and European human rights law, especially the rights to freedom of expression and religion; minority rights; participatory rights, and cultural and linguistic rights. His other main area of expertise is international, European and comparative media law and policy. Themes such as pluralism, diversity, tolerance and “hate speech” have a central place in his research.
